Why This Matters Now
-
This isn't ancient history. The aid continues. $3.8 billion per year flows in direct violation of federal law. Equipment provided under this illegal aid has been documented in operations that have killed American citizens abroad.
The Symington and Glenn Amendments aren't suggestions. They're the law. They've been the law for nearly 50 years. The only thing missing is enforcement.
At some point, someone has to ask: If we're not going to enforce our own nonproliferation laws, why do we have them?
The Symington Amendment is codified at 22 U.S.C. § 2799aa. The Glenn Amendment is codified at 22 U.S.C. § 2799aa-1. The Vanunu conviction is a matter of Israeli public record. *The Vela incident is documented in declassified U.S. intelligence files.
Every Dollar of U.S. Aid to Israel Has Been Illegal Since 1988
-
There are two laws sitting on the books that nobody talks about. They're not obscure. They're not ambiguous. They're just ignored.
The Symington Amendment (1976)
-
22 U.S.C. § 2799aa states that no U.S. funds may be used to provide assistance to any country that acquires nuclear enrichment technology outside of International Atomic Energy Agency safeguards.
Not "the President may consider reducing aid." Not "Congress should review assistance levels."
No funds may be used.
The Glenn Amendment (1977)
-
22 U.S.C. § 2799aa-1 goes further. It mandates that the President shall terminate assistance to any country that detonates a nuclear device.
Here's the kicker: unlike Symington, the Glenn Amendment has no presidential waiver provision for the detonation trigger. None. Zero. Congress specifically wrote it that way.
Israel's Problem
-
Israel maintains a policy of "nuclear ambiguity"—officially neither confirming nor denying it possesses nuclear weapons. Diplomatically convenient. Legally meaningless.
Because on March 24, 1988, Israel convicted Mordechai Vanunu of treason and espionage for revealing details of Israel's nuclear weapons program to the British press. He received an 18-year sentence, including 11 years in solitary confinement.
Think about that for a moment.
You cannot commit treason by revealing secrets that don't exist.
You cannot be guilty of espionage for sharing fabrications. Treason, by definition, requires the disclosure of actual state secrets. Israel didn't imprison Vanunu for 18 years for making up stories. They imprisoned him for telling the truth.
The Vanunu conviction is Israel's judicial admission—made under oath, through its own legal system—that the nuclear weapons program he described is real.
Israel's "ambiguity" may satisfy diplomatic sensibilities. It cannot survive legal scrutiny.
The 1979 Vela Incident
-
On September 22, 1979, a U.S. Vela satellite detected a distinctive "double flash" over the South Atlantic—the unmistakable signature of a nuclear detonation. The scientific consensus, supported by multiple analyses including a 2018 study using newly declassified hydroacoustic data, concludes this was an Israeli nuclear test, likely conducted jointly with South Africa.
- If true, this triggered the Glenn Amendment's no-waiver provision in 1979.
What This Means
-
Since at least 1988 (Vanunu conviction) and arguably since 1979 (Vela incident), every single piece of U.S. military equipment transferred to Israel has been illegal under American law:
* Every F-35
* Every bomb
* Every round of ammunition
* Every Caterpillar D9 bulldozer
* Every dollar of the $3.8 billion annual aid package
The language of these statutes isn't discretionary. It's mandatory. "No funds may be used." "Shall terminate." Congress wrote these laws specifically to prevent the executive branch from looking the other way on nuclear proliferation.
And for 45 years, every administration—Republican and Democratic—has done exactly that.
The Question Nobody Asks
-
The standard response is that no President has ever formally "determined" that Israel violates these amendments.
But the statutes don't require a presidential determination.
They self-execute upon violation. The mandatory language kicks in when the facts are met, not when the President acknowledges them.
And Israel already made the factual determination for us. When Israel convicted Vanunu of treason for revealing nuclear weapons secrets, it established—through its own judicial system—that those secrets are real.
We don't need the CIA to tell us what Israel's own courts have confirmed.
