Efter 18 år som spansk advokat har jag sett många köp gå bra – och några gå väldigt fel.
Här är min kompletta checklista över vad jag skulle kontrollera innan jag köper en bostad i Spanien.

Buying a property with occupants in Spain can actually be a good investment opportunity if the price reflects the risk. But the key is understanding exactly what kind of occupancy you’re dealing with.
There’s a big difference between:
• A tenant who stopped paying rent (legal contract that has expired or been breached)
• Someone who entered illegally (okupa puro)
The process changes a lot depending on that.
You also need to check if there are minor children living there, or if the occupants have been declared “vulnerable”. Both things can significantly slow down an eviction.
In Spain the eviction procedure (desahucio) roughly works like this:
1. You file a claim in court (juicio de desahucio).
2. The judge sets a date for the hearing.
3. If the occupants don’t leave voluntarily after the judgment, you request the actual physical eviction (lanzamiento).
4. The court sets a date for the police/ locksmith to carry it out.
It can take anywhere from 4-5 months in the best cases to well over a year if there are minors, vulnerability claims, or appeals. And during that time you usually can’t renovate or rent the property.
So the discount has to be big enough to compensate for the time, legal costs and uncertainty. When it is, these deals can make sense. When it isn’t, they become a headache.

En snygg broschyr och ett bygglov skyddar inte dina förskottsbetalningar.

Sedan får byggherren ekonomiska problem.
Är pengarna förlorade?
Inte nödvändigtvis. Förskottsbetalningar vid bostadsbyggen omfattas av ett särskilt skydd. 🧵
Byggherren ska normalt garantera de belopp som köparen betalar i förskott, inklusive genom bankgaranti eller försäkring enligt lagens villkor.
Det är därför viktigt att kontrollera garantin – inte bara betalningsplanen – innan större belopp överförs.
The lesson?
When buying property in Spain, don’t only ask:
“Do I like this house?”
Ask:
“Does the house I am looking at match the house I am legally buying?”

There is only one problem:
Legally, that swimming pool may not exist.

It happens more often than foreign buyers imagine. 🧵
This is why property due diligence in Spain should not stop with a Land Registry extract.
For a villa, I want to compare:
→ what physically exists
→ Land Registry
→ Cadastre
→ planning information
→ licences and technical documents
The discrepancies tell the story.

From the legal side in Spain I see the same pattern: the biggest risks usually appear after the search is done — hidden debts in the community, urban planning issues, or tax surprises for non-residents.
Having someone who only works for the buyer + a local lawyer who actually checks the paperwork makes a big difference.
Good to see more people focusing on the buyer��s side.
@MoneyTelegraph Spain is not necessarily a “tax trap”, but moving here without understanding tax residency, wealth taxation and the consequences of owning property can become expensive. The key is to analyse the position before becoming resident, not afterwards.
@idealista Más allá del debate económico, desde la práctica jurídica hay otro efecto: cuanto más complejo se vuelve el marco regulatorio del alquiler, más importante es que el propietario conozca exactamente qué régimen se aplica a su vivienda antes de fijar renta, duración y condiciones.
En la Comunidad Valenciana veo además una cuestión práctica: muchos propietarios extranjeros se plantean alquilar, pero distinguen mal entre alquiler de vivienda, temporada y turístico. Son regímenes jurídicos distintos y elegir mal desde el principio puede generar problemas importantes.
Desde la Costa Blanca veo otro factor: no existe “un” mercado inmobiliario español. En determinadas zonas la demanda internacional, la obra nueva limitada y el suelo disponible producen dinámicas muy distintas a las de otras ciudades españolas. Analizar España como un solo mercado puede llevar a conclusiones engañosas.
@Finansavisen Helt enig. I Spania bør den juridiske kontrollen starte før kjøperen binder seg økonomisk. Register, matrikkel, byggetillatelser og den faktiske boligen stemmer ikke alltid overens. De dyreste problemene er ofte de man ikke ser på visningen.
Min viktigaste regel efter 18 år med fastighetsaffärer i Spanien:
Köp inte först och kontrollera sedan.
Kontrollera först. Förstå exakt vad du köper, vilka risker som finns och vad det faktiskt kommer att kosta.
Sedan kan du köpa.
