Annoyingly, one of the cases that prompted @librarianth and I to start thinking about this issue was recently settled. By a confidential out-of-court agreement. Of course it was. 🤨 So the uncertainty persists!

TYes, there are factors to consider in the use of exceptions but they exist & using them is perfectly legitimate for authors and publishers alike.
