In all humility and with complete respect for judiciary, I have written the following letter to Justice Swarna Kanta Sharma, informing her that pursuing Gandhian principles of Satyagraha, it won’t be possible for me to pursue this case in her court, either in person or through a counsel.

I have taken this difficult decision after coming to the clear conclusion that the proceedings being conducted in her court do not, in any manner, satisfy the fundamental principle that ‘justice must not only be done but must also be seen to be done’. My participation in these proceedings, either myself or through a counsel will not achieve anything meaningful.

I was listening to your press conference today. Among the three options, if there is no way you can continue working with AAP, you could have left AAP and resigned from your MP post. Joining the BJP is not just gaddari to Arvind Kejriwal who trusted in you and other AAPians who believed in you; it is gaddari to 1.4 billion Indians.

Others may have reasons to bend under pressure, but you do not have any reason to bend to any pressure. You should never be seen as a gaddaar in the eyes of your daughter. Joining BJP is an insult to every single day of your life so far, which you have led with relentless hard work, facing hurdles at each step.

As you yourself said, there are many other ways of nation-building. Let us work on those options. Please do not go to BJP. This country needs more people like you to fight for restoring the normal functioning of institutions.

It is okay to not know the art of politics. It is okay to not always have common sense. Our education has taught us humility - to accept our failures and to accept what we do not know. But doing gaddari is not at all a solution to this.

If you cannot stand internal politics within AAP, imagine - you may not be able to sustain even one day in BJP. They will swallow you in no time. We are just ordinary people (read that 100 times). It is okay to lose 10 years of your life fighting for a rightful reason and not succeed. But please do not go to BJP. It has only been a few hours since you joined, and 1.4 billion people are counting on you.

This was the donation I made to AAP Chhattisgarh last May after knowing that Sandeep was the Chhattisgarh Prabhari. I do not have visibility into what is happening on the ground, but I could sense that something was off. Sandeep was someone I truly looked up to.

In many ways, I saw myself in him - an educated person who genuinely wanted to bring change in the system, who sacrificed his career and worked very hard during the Punjab elections. I know I wanted to be like that one day, but I am still not sure if I can move back to India due to my own constraints. So I wanted him to succeed in his goal of bringing REAL CHANGE on the ground (after learning from his past lessons).

That is why I made this donation. I could not post it then, as I felt he may not have been comfortable with it at that time. I am posting it today along with the original message I had shared with a few leaders internally while sending this donation certificate to them.

I took reference of Manoj’s Daadi in 12th Fail movie. We all knew that the hard-earned life savings of Manoj's Daadi were stolen. But Manoj did not turn into a traitor in his Daadi’s eyes.

I am hoping for a miracle in this real-life story too, even as I watch these dramatic events unfold today 🙏

An ordinary middle-class girl from a small town in Andhra Pradesh, is donating her hard earned money to Aam Aadmi Party Chhattisgarh unit today, because she believes in the power of opportunity as she has lived what opportunity can do.

In India, the arc of our lives is too often written before we can even dream - by our birth, our gender, our caste, our class. I happened to be lucky, being born into a middle-class family that valued education, I was given that one opportunity that can break all barriers - learning. That education led me to a job, to independence, to a voice - and today, that voice says- 'every child deserves the same shot at life, no matter where they are born'

Because AAP will dare to change their future.

And why to AAP Chhattisgarh ? Because, this same education has made a huge difference in one man’s life who now sacrificed his career to be part of AAP in order to bring BADLAAV in this country and is currently prabhari of Chhattisgarh. He is a huge inspiration to me and I am contributing my hard earned money, because I have complete trust in his integrity, and he will start a powerful movement in Chhattisgarh.

Now is the time to build something strong, rooted, and visionary in Chhattisgarh. This is why I hope my donation fuels the upcoming local body elections in CG - the stepping stones for solid support base to form for AAP

In the court of Hon’ble Justice Swarn Kanta Sharma, Mr. Arvind Kejriwal has filed another affidavit.
In it, he has stated that both the children of the Hon’ble Judge are working on Central Govt Panels ie under Sr Adv Tushar Mehta. Mr. Tushar Mehta assigns cases to them. In such a situation, it would be difficult for the Hon’ble Judge to pass any order against Mr. Tushar Mehta.
Therefore, along with other reasons, the Hon’ble Judge should recuse herself from the case.

Unbelievable.. Unprecedented.. Unmatched..

Make no mistake, what Arvind Kejriwal did in High Court is not ordinary. The day will be marked as a defining moment in Indian democracy. His arguments will be remembered and recalled whenever recusals and fairness of judges will be in question.

AAP is not a party that has habitually complained about fairness of the judiciary. The respect and belief has always been there. There are strong reasons behind this recusal application.

When Arvind Kejriwal argued his case in front of Justice Swarna Kanta Sharma, he maintained calm. He was absolutely professional about it. The strongest of apprehensions were presented with carefully selected words. Not once he spoke in a way that was disrespectful to judiciary.. such clarity and understanding of discipline of a court room from a politician who has never practiced law was outstanding.

He has now set a template for others to follow who may fear that the judge may not be fair to them. This man continues to be a revolutionary.

It’s important to discuss the arguments he made today to understand the significance of what he has achieved irrespective of the judgement that is to follow.

1. On 9th March when CBI approached High Court, justice Swarna Kanta was quick to call the session court’s discharge order as erroneous without even hearing the other side. In fact, the other side was not even present in court. How can a judge make such strong observations on a discharge order that came after months of countless hearings in the lower court? The other party, here Arvind Kejriwal has all the right to feel apprehensive. 

2. The sessions court had ordered an enquiry against the investigating officer and with strong statements attached. In fact, the court called the investigation pre-determined, which means that the IO was certain who he wanted to implicate. The proceedings against this IO were stayed despite the IO not being present in the court or even requesting for a stay. What was the hurry to give relief to the IO that all procedures had to be brushed aside? 

3. Justice Swarna Kanta Sharma when rejecting bail applications of the accused in the past, made strong observations that allowed news channels to pick headlines to openly call the accused guilty. Typically when hearing a bail application, a judge simply accepts or rejects the bail. What was the need to make adverse observations without a trial?

4. The Supreme Court set aside Justice Swarna Kanta’s orders in all these bail applications.. no exceptions. Perhaps Swarna Kanta ji could be wrong about one or two applications but all her orders being set aside raises serious questions.

5. Justice Swarna Kanta’s son and daughter are empaneled by the BJP government. How can Arvind Kejriwal or any accused expect from the judge here to be fair when her kin are working for their political rivals?

6. It’s probably okay for a judge to attend events related to any ideology but Justice Swarna Kanta Sharma attended 4 events of Adhivakta Parishad, a body of the RSS. She never attended events organized by groups belonging to any other ideology. How can Arvind Kejriwal expect a fair judgement from a judge who has been exclusively attending RSS events?

I have discussed just a handful of arguments from those that Arvind Kejriwal presented today. He stood in front of the same judge he wanted recused. It was an awkward situation to say the least but the manner in which he presented his case today left many in awe. 

Today, he walked out of the court winning many more admirers. His presence along with his arguments have changed a lot of things in India today. I can’t yet pin point but everybody who understands judiciary can feel it in the air. 

I recall somebody famously once said.. finally it took Arvind Kejriwal to fix PMLA. I feel a similar statement but on the present subject is on the way after his brilliance today. 

This man is made up of some hard steel. Salute.
