Why was the 3rd Impeachment Case Against Marcos Jr was not acceptedwhen the “rules say yes?

Under Article XI of the 1987 Constitution, impeachment complaints against the President may be filed by any citizen upon endorsement by a Member of the House. The Constitution is deliberately broad and permissive at the filing stage. It does NOT require:

- prior screening by House leaders,
- political blessing from the Speaker,
- nor the physical presence of a particular official holding a particular pen.

The Constitution’s intent is crystal clear: access first, filtering later. Yet what happened?

The third impeachment complaint, even I think the second one, those touching the politically sensitive issues like budgetary manipulation, flood-control allocations, and massive corruption in government, among others, were stopped at the door. Not debated. Not docketed. Not even received. Why?

Because the House Office of the Secretary General (OSG) allegedly could not accept them since Secretary General Cheloy Garafil was physically unavailable, as she is in Taipei to receive Taiwan’s Order of the Brilliant Star with Grand Cordon.

This is what you call governance by attendance sheet. Is this a new political invention of the HOR and the Marcos Jr. regime? This is quite absurd, right? This is classic procedural obstruction. Indeed, the message being sent is:

- You may file, but only if we allow you to.
- You may accuse, but only in forms that don’t threaten us.
- The Constitution is alive but on mute.

In any case, what’s the absurdity here? Is filing ≠ a personal reception?

Let’s be very clear. The House Rules say impeachment complaints are to be filed with the OSG, NOT hand-delivered like flowers to the Secretary General herself. The OSG is an institution, not a handbag. Filing is a procedural requirement. Duh!

What I can surmise, and let’s talk about the quiet part out loud, the elephant in the room, the “one-year bar” weaponization.

Under the Constitution, only one impeachment proceeding may be initiated against the same official within one year. So timing is everything. By allowing a weak, single-endorser complaint to move first, and blocking subsequent complaints on “technical” grounds, the House effectively turns impeachment into a calendar trap.

This is why the first impeachment complaint, which was accepted by OSG, is called an “inoculation.” You don’t need to win the case; you just need to occupy the slot. It’s not accountability, it’s queue management.

And democracy? Ah Yes! Democracy? This episode tells citizens something profoundly corrosive: You have the rightto file. But not the ability to be received.

Folks, when the filing is blocked, democracy quietly degrades into administrative discretion. If the House can “pause” an impeachment filing simply because the Secretary General is abroad, then impeachment stops being a constitutional remedy and becomes a managed process, available only when the gatekeepers feel like opening the door. And when accountability depends not on law, but on logistics and loyalty, the Constitution may still exist, but it is no longer in charge. It becomes a décor.

And that should worry every Filipino, regardless of political affiliations or leanings. Because once the acceptance of a complaint depends on the discretion of those in power, rather than the rules that bind power, then we are no longer governed by laws or by our very Constitution. We are governed by the permissionand discretion of those who sit on the throne of power. And a democracy that runs on permission and discretion is already drifting toward something else, -authoritarianism without tanks, but authoritarianism with office hours.
