Most people agree that if someone has a real mental illness, they should get help. But California’s mental health diversion law has gone off the rails.

You don’t need to be a licensed psychiatrist, psychologist, or medical doctor to give one of these diagnoses. Marriage counselors and therapists can do it. Right now, almost anyone can be diagnosed with a condition after committing a crime and use it to avoid jail. Nearly 300 conditions qualify, including things like Tourette’s, ADHD, anorexia, insomnia, gambling disorder, substance abuse (including alcohol, tobacco, and marijuana), and even erectile dysfunction can be labeled as a mental health disorder, preventing a person from serving jail time for some of the most evil crimes imaginable.

These diagnoses don’t have to be pre-existing. Offenders can commit a crime and receive a qualifying diagnosis afterward.  One therapist admitted they gave out a diversion-eligible diagnosis in every single case they reviewed – almost 300 times.

Another said under oath that she doesn’t even go through all the criteria.  She simply picks a diagnosis if some symptoms seem to fit. When offenders are granted diversion, they are not sent to a secure treatment facility like a state hospital. They are released into the community with virtually zero supervision or controls to help protect the public from the danger they may pose.

To make matters worse, the courts are required to assume their diagnosed disorder caused their crime.  Prosecutors now have to prove the diagnosis DID NOT cause the defendant to commit the crime, not the other way around - which is almost impossible.

There must always be a balance between public safety and the rights and needs of offenders. Unfortunately, in California, that balance has been lost.  California’s diversion program is a back-door legal loophole to let dangerous criminals walk free, and it’s putting all of us at risk. California needs to fix this. Fast.

WATCH: Assembly Elections Chair @gailforassembly refuses to answer questions after blocking a bill that would prohibit use of NDAs in California’s lawmaking process.

She said she didn’t have enough time to review the bill, despite her record of voting for fast-tracked bills.
