The 2022 amendments to the Oklahoma Youthful Offender Act shifted the discretion over charging and accountability determinations in cases involving 15-, 16-, and 17-year-olds charged with first-degree r*pe or attempted first-degree r*pe from the reviewing judge to the district attorney.
The original DA on the case was Laura Austin Thomas. Under her administration, Jesse Butler was prosecuted as a youthful offender. Yes, the original DA was a female.
Special Judge Susan Worthington ultimately approved the youthful offender disposition and rehabilitation plan as REQUIRED under Oklahoma LAW. According to the Oklahoma Youthful Offender Act, the authority to make charging and accountability determinations in these cases was SHIFTED from the reviewing judge to the district attorney.
It is not judicial misconduct for a judge to correctly apply the law, regardless of how unpopular that law may be or what unintended consequences it may have. That is precisely what a judge’s oath requires.
THEREFORE, if you want to go after anyone, you need to go after those who authored, passed, and signed the 2022 amendment to the Oklahoma Youthful Offender Act.
Sen. Brent Howard, a Republican, authored the bill. Rep. Dustin Roberts, also a Republican, co-authored the bill in the Oklahoma House of Representatives. The Oklahoma Legislature then passed it by overwhelming margins.
43-0 in the Senate and 74-4 in the House … before Republican Gov. Kevin Stitt signed it into law.
