I think we need to do away with this presidency system. After all, it wasn’t originally ours, it’s a colonial concept that has contributed to the destabilisation of Africa.
If Uganda was a serious Country, media outlets like Next Media’s @sanyukatv that advertise or provide a platform for unlicensed or fraudulent businesses, in this case Skypins Tours and Travel had to face both legal and ethical liability for their big involvement in promoting this scam. But No one cares😭😭
Under tort law in Uganda, Sanyuka TV is very much liable for negligent misrepresentation to promote Skypins without verifying its legitimacy, causing financial loss to consumers who relied on its advertisement of that company and thorough promotion of its boss, Don Chris. But No One Cares😭😭
All media stations under that tort of law have a duty of care but Sanyuka breached that duty, and resulted into harm. Media houses, as influential platforms, owe a duty to their audience to ensure advertisements are not misleading or harmful. But No One Cares😭😭
Sanyuka TV has been advertised Skypins Tours and Travel as a legitimate labor recruitment agency without verifying its licensing status with @Mglsd_UG thus breaching their duty of care.
Victims who paid Skypins (up to UGX 15 million per person) after seeing advertisements or interviews on Sanyuka TV have claimed they relied on the channels’ implied endorsement, leading to financial loss. But No One Cares😭😭
If Don Chris’s Victims get good probono lawyers, they can file a civil suit against Sanyuka TV for damages, seeking compensation for losses incurred. The court would assess whether Sanyuka TV acted recklessly or negligently by failing to verify Skypins’ credentials, especially given the MGLSD’s public list of licensed recruitment agencies. But No one Cares😭😭
In the same legal context, Sanyuka TV is liable again for ‘Aiding and Abetting Fraud’.
Under Section 305 of the Penal Code Act (Cap 120), aiding or abetting a criminal offense, such as obtaining money by false pretenses, can result in criminal liability. If a media house like Sanyuka knowingly or recklessly promotes a fraudulent enterprise, it could be considered an accessory to the crime. But No One Cares😭😭
If Don Chris’s victims probono lawyers provide evidence that shows that Sanyuka TV was aware or should have reasonably suspected that Skypins was unlicensed or fraudulent, their continued promotion could constitute aiding and abetting. But No One Cares😭😭
Lastly, the Media Council of Uganda, under the Press and Journalist Act, 1995 (Cap 105),requires media outlets to ensure responsible journalism. @UCC_Official also enforces advertising standards to prevent misleading content. Broadcasting advertisements for an unlicensed company automatically violates these standards. But No One Cares😭😭
Therefore, Sanyuka TV’s failure to verify Skypins’ legitimacy before airing ads or hosting its boss for interviews breaches UCC guidelines or Media Council standards, since these promotions misled viewers into believing Skypins was a legitimate business.
But no one cares in this Country! The station is trying as much as it can to protect its client and much airtime is being accorded to him for damage control!
