🇷🇴 Venice Commission: "The decisions of the BEC and Constitutional Court raise SERIOUS CONCERNS regarding respect for DEMOCRATIC PRINCIPLES and the right to FREE ELECTIONS in Romania"

The Venice Commission adopted the urgent report titled “On the Annulment of Election Results by Constitutional Courts” (CDL-AD(2025)003), which includes a specific analysis of the situation in Romania.

The report confirms the preliminary conclusions from January 27, 2025, and adds observations about recent events, including the rejection of Călin Georgescu’s candidacy by the Central Electoral Bureau (BEC) on March 9, 2025, and the decision of the Constitutional Court of Romania (CCR) on March 11, 2025.

The Commission reiterated that the annulment of elections (in the case of the 2024 vote) cannot be justified solely based on classified information provided by intelligence services, without concrete and transparent evidence presented to the public. This stance was already expressed in the January report but was reaffirmed as applicable to the current context.

Regarding the rejection of Călin Georgescu’s candidacy for the May 2025 elections, the Commission emphasized that the exclusion of a candidate from the electoral process must be based on a final criminal conviction or clear violations of electoral law, demonstrated transparently. In the absence of such a conviction (as of the session date), the decisions of the BEC and CCR raise “serious concerns regarding respect for democratic principles and the right to free elections,” in line with Council of Europe standards.

The Commission noted that, although Georgescu faces serious allegations (including incitement to actions against the constitutional order and ties to extremist groups), the judicial process is ongoing, and his preemptive exclusion without a final court ruling “may be perceived as an unjustified interference in the electoral process.”

Recommendations:
The Commission urges Romanian authorities to ensure a transparent and fair electoral process for the elections scheduled for May 4 and 18, 2025, including by reviewing candidate validation procedures to avoid arbitrary decisions. It also recommends that any restrictions on the right to run for office be proportionate and well-grounded in law.

The report and statement were posted on the Commission’s website in the “Plenary Sessions” and “Adopted Opinions” sections this morning, March 16, 2025.

The official outcome is now available and confirms that the Venice Commission criticizes both the annulment of the 2024 elections and the handling of Călin Georgescu’s candidacy rejection for the upcoming vote.

However, the Commission’s position is advisory, lacking direct legal authority, and the implementation of its recommendations depends on Romanian authorities and the response of European institutions.

Insufficient Legal Framework: The Venice Commission does not outright deny a constitutional court’s ability to annul elections or act ex officio, but it stresses that such powers must be explicitly regulated and limited to exceptional circumstances. Romania’s legal framework does not adequately define these conditions, allowing the CCR to act without clear democratic guardrails, which deviates from international norms.

🇷🇴 The establishment has permanently banned Calin Georgescu from running. But the battle is just beginning...

Georgescu essentially slapped the label of the "deep state approved candidate" on every candidate from the establishment who will appear on the ballot.

I didn’t vote for him in the first round, but the phenomenon he created by running for President led to the Great Reveal of the deep state's true colors.

Their undemocratic actions blew up HARD in their faces worldwide and whoever the next President might be, he'll contested before even becoming President.

The 🇪🇺 citizens saw what lengths the deep state will go to in order to prevent a nationalist from taking power in the current geopolitical context. This should be a HUGE warning for other countries.
