In 2014, the Same Sex Marriage (Prohibition) Act was signed into law by President Goodluck Jonathan. This law prohibits same-sex marriages and civil unions and imposes severe penalties on individuals and organizations that engage in or promote such relationships. Under the Act, individuals entering into a same-sex marriage or civil union can face up to 14 years in prison. Public displays of same-sex relationships and the activities of LGBT organizations are also strictly prohibited, with violators facing up to 10 years imprisonment.

Unless the law is repealed, the Samoa Agreement cannot automatically repeal this law for the following reasons:

1. Legislative Supremacy: In Nigeria, the power to make and repeal laws rests solely with the National Assembly, which comprises the Senate and the House of Representatives. The legislative process involves drafting, debating, and passing bills, which must then be assented to by the president. This rigorous process ensures that laws are made through a democratic and transparent procedure. An agreement, which is essentially a contract between parties, does not have the authority to override or repeal laws passed through this legislative process.

2. Constitutional Framework: The Nigerian Constitution outlines the separation of powers among the executive, legislative, and judicial branches of government. The National Assembly's role is to legislate, the president's role includes assenting to bills, and the judiciary interprets the laws. Allowing an agreement to repeal a law would bypass this constitutional framework, undermining the principles of democratic governance and the rule of law.

3. Legal Hierarchy and Authority: Laws enacted by the National Assembly hold higher legal authority than agreements, which are typically binding only on the parties involved. Even if an agreement is signed by government officials, it does not carry the same weight as a statute passed by the legislature and cannot unilaterally alter or nullify statutory provisions.

4. International and Domestic Legal Obligations: While international agreements and treaties can influence domestic law, they do not automatically have the power to repeal existing legislation unless they are incorporated into national law through the proper legislative process. In Nigeria, for an international agreement to have legal effect, it must be ratified by the National Assembly. Until such ratification occurs, the provisions of the agreement cannot override domestic laws.

5. Judicial Precedents and Interpretations: Nigerian courts have consistently upheld the principle that statutes cannot be repealed or amended by agreements or executive actions alone. Judicial interpretations reinforce that legislative acts remain in force until duly repealed or amended by subsequent legislative action.

What does this mean? It means that the Same Sex Marriage (Prohibition) Act, enacted in 2014, remains in force until it is repealed or amended by the National Assembly through the constitutionally prescribed legislative process. This also means that the Samoa Agreement cannot automatically repeal the law because it does not possess the legal authority to override statutes passed by the legislature and assented to by the president. This maintains the integrity of Nigeria's legal and constitutional framework, ensuring that changes to the law occur through a democratic and transparent process.

Therefore, the eyes should now be on the National Assembly to ensure that the Same Sex Marriage (Prohibition) Act remains in force as it is consistent with the will of the Nigerian people as Islam, Christianity and all other religions are against this immorality and the legal principles governing the nation.
