CBIC ने 15 अक्टूबर 2024 को Circular No. 238/32/2024-GST जारी किया था। इस Circular को Bombay High Court में चुनौती दी गई है Maas infra and Logistic ने

मामला यह है कि अगर किसी taxpayer पर GSTR-1 और GSTR-3B में अंतर के कारण tax demand बनी है, तो Circular के अनुसार उसे Section 128A के तहत tax waiver का लाभ नहीं मिलेगा।

याचिकाकर्ता ने इसी बात को High Court में चुनौती दी है।

Bombay High Court ने इस Writ Petition को सुनवाई के लिए स्वीकार कर लिया है और इसी तरह के एक दूसरे मामले के साथ इसकी सुनवाई करने का निर्देश दिया है।
