🚨🚨🚨 MAJOR ASA VICTORY IN NFA CHALLENGE🚨🚨🚨
Judge in 5th Circuit Finds NFA Unlawful for $0 Tax Items!!
Updates coming soon, in the meantime here is a copy of the decision:
Protecting the rights of law-abiding gun owners from future anti-gun administrations is critical. Thank you for the update @ATFDirectorRC and thank you for working to protect those rights.
UPDATE>Jensen v. ATF
FACTS> CLICKBAIT.
There's a lot of misinformation circulating about the recent NDTX ruling in Jensen v. ATF; including a headline claiming, "ATF is Furious and We Are Planning Brutal Revenge on Gun Owners."
The source? You guessed it: unnamed anonymous sources. It's completely FALSE.
**More importantly - ATF respects the Court's ruling and the rule of law. We are following the order and will not take enforcement action against protected parties inconsistent with that ruling. We are working diligently on clear guidance. Getting it RIGHT matters more than getting it out fast.
That means carefully navigating federal and state laws so that manufacturers, FFLs, and law-abiding gun owners aren't left with legal problems - today or under a future administration.
Thank you for your patience as we focus on developing the guidance. It will be posted online as soon as we are done. The American public and the 2A community deserve facts NOT clickbait.
For the first time in ninety-one years, many Americans can buy a suppressor without a Form 4 and without waiting on ATF approval. And for everyone, the $200 stamp is gone.
That didn’t happen by accident. And the fight isn’t finished.
For four days only, Cole-TAC is donating 30% of the proceeds from every suppressor cover purchased directly to the ASA.
Thursday, August 27 through 11:59 p.m. MDT on Sunday, August 30. No code. No minimum.
Cover your can! Fund the fight!
A huge thank you to SIG SAUER for committing $50,000 as a Tier 2 sponsor of the ASA.
The support of industry leaders like SIG SAUER makes our work possible. When you have the opportunity, support the companies that support your rights.

On July 23rd, the Trump Administration posted two interim final rules transferring “sound suppressors for non-automatic and semi-automatic firearms” from State Department jurisdiction to the Commerce Department, effective November 20th.
The change marks a major step toward allowing American hunters to travel abroad with their suppressors and giving American businesses access to established international commercial markets.
ASA has led the charge to legalize commercial suppressor exports for more than a decade. We’ll continue working with the Administration to clarify that all commercially available suppressors are eligible under the new rules, and keep you posted.
On July 1st, 2013, ASA backed Senate File 132 took effect, making Wyoming the 28th state to legalize suppressor hunting. The legislation, which was signed into law by former Governor Matt Mead (R) on February 18th, 2013, was carried by Sen. Ogden Driskill (R-1).
The ATF has released its July 2026 suppressor registration numbers.
There are now 6,654,209 registered suppressors in the United States.
...and still counting.
The federal district court's decision in Jensen v. ATF created a significant opportunity for suppressor dealers.
Join ASA and TSRA with one dual membership. Membership positions your dealership within the current scope of the Jensen v. ATF ruling, allowing eligible suppressor transfers to be processed on a 4473 rather than a Form 4, subject to the court's order and applicable law.
What You Need to Know
The ruling:
- Applies only to the named plaintiffs and the organizational plaintiffs' members and customers.
- Does not eliminate the NFA.
- Dealers must have an SOT
- Dealers should continue following current law and should consult with their legal counsel prior to changing how they process NFA transfers.
- Dealers must be located in one of the 27 qualifying states and not in one of the 15 states with a statute that references the NFA or federal law.
This Is Just the Beginning.

We’re continuing to take action in Jensen v. ATF, ensuring the federal government complies with the court’s injunction.
Today, counsel for the plaintiffs formally pressed @TheJusticeDept for answers on how it will implement the court’s judgment and ensure compliance nationwide.
Along with our partners — @AmSuppressor, @2AFDN, and @gunpolicy — we won’t stop fighting until the NFA is DISMANTLED.

At 1:30 PM CT, the court will hear oral arguments during the summary judgment hearing in Brown v. ATF before the U.S. District Court for the Eastern District of Missouri.
Following Congress's elimination of the NFA tax on suppressors through the One Big Beautiful Bill Act, this lawsuit argues that the NFA's registration regime can no longer be justified under Congress's taxing power. It also challenges the NFA's registration requirements for suppressors and short-barreled rifles under the Second Amendment.
The lawsuit was filed by the ASA, @NRA, @2AFDN, @gunpolicy, Prime Protection STL Tactical Boutique, and two members of the organizations.
Stay tuned for updates as today's hearing unfolds.
In mid-July, the ASA joined the @NRA, @2AFDN , and @gunpolicy in filing an amicus brief in support of U.S. v. Machamer. While the case does not directly involve suppressors, the brief urges the Sixth Circuit to strike down the NFA's registration requirements for short-barreled rifles as unconstitutional.
This case highlights the Second Amendment community working together to defend constitutional rights. We commend the NRA for leading the effort and extend our sincere thanks to Joe Greenlee for his outstanding work on the brief.

@AmSuppressor@NRA@gunpolicy and @2AFDN teamed up to fund and support 3 lawsuits challenging the NFA. Yesterday, the first major decision was released in our Jensen case.
If you’re wondering what it all means, our friend @MorosKostas did a terrific write up. Check it out:
A thread on this just-announced win for SAF against the NFA!
Read on with the understanding though that I (Kostas) do not have nearly the level of knowledge on the taxing power that I do on Second Amendment issues. But I'll do my best to hit the highlights of the ruling.
