5. Rejoin the EU but let everyone who voted to leave pretend that we still have

Dogs must be kept on a lead on the highway, Dog walkers must clean up their dogs poo, unless the walker is exempt due to disability or the dog is exempt because it is a working dog.

Statically minded people. Is there a name for a fallacy in the following scenario. In favour of scheme 1%. Against 2%. 97% of those that could respond did not. Therefore the decision maker argues that 98% of the population are in favour (counting no response as in favour)
