I’ve spent the past several days on X addressing widespread misinformation about U.S. immigration law.
My posts have focused on three areas where facts are routinely distorted: asylum at ports of entry, Temporary Protected Status (TPS), and recent Immigration and Customs Enforcement (ICE) operations. What follows is a clear, law-based summary of those discussions.
Asylum at Ports of Entry: The Law Is Not Optional
One persistent myth is that presenting yourself at a U.S. port of entry guarantees you the right to apply for asylum and that it is consequence-free.
That is simply wrong.
Under INA § 235(b)(1), any alien who presents for admission without valid entry documents—or who is inadmissible due to fraud or misrepresentation—must be placed into expedited removal proceedings. The statute is mandatory, not discretionary. Detention follows, but if a fear of return is expressed a credible fear interview is scheduled to be conducted by an asylum officer.
As I stated plainly in one post:
“All aliens that present themselves for admission at a port of entry are not guaranteed the right to apply for asylum. An asylum officer must first evaluate whether you have a credible fear of returning to your country of origin.”
If the asylum officer finds no credible fear, the alien may seek limited de novo review by an immigration judge. That review is narrowly confined to whether there is a significant possibility the person could establish eligibility for asylum—a high bar by design. If the negative credible fear finding is upheld, removal is executed without a full asylum hearing.
Congress enacted expedited removal in 1996 to balance border control with humanitarian safeguards. In practice, however, the Biden administration routinely bypassed these statutory requirements, permitting entry without enforcement of the law as written. That is policy-driven noncompliance, not humanitarian necessity.
TPS for Haitians: Lawful Status Not Required
Another recurring claim—particularly from elected officials—is that recipients of TPS all entered the United States legally as a prerequisite.
That claim is also false.
Temporary Protected Status for Haitians does not require lawful admission. USCIS is explicit: Haitians who entered without inspection may still qualify, provided they meet the statutory requirements, including continuous residence since the designation date.
In response to statements by New York Governor Kathy Hochul regarding Haitian TPS, I clarified:
“Temporary Protected Status (TPS) for Haiti does not require lawful admission… Haitians who entered illegally without inspection can still apply for and be approved for TPS, provided they meet the other eligibility criteria.”
ICE Enforcement: Public Safety Still Matters
Recent ICE enforcement actions have also drawn attention, particularly arrests involving convicted violent offenders.
ICE Buffalo recently arrested Jose Mendoza, a Salvadoran national convicted of felony criminal sexual acts, sexual abuse, and family neglect. He served 25 years in prison and has had a final order of removal since 2006. As ICE stated, he is now in custody pending removal.
Similarly, ICE Salt Lake City arrested Marcos Navarez-Zamora, a Mexican national convicted of felony rape and sentenced to 32 years, immediately upon his release from state prison on January 20.
My response was straightforward: why was he released without coordination in the first place?
These arrests are part of broader enforcement initiatives such as Operation Metro Surge in Minnesota. According to DHS and ICE, approximately 3,000 criminal aliens have been arrested since December 4, 2025—many with convictions for violent crimes and sexual offenses. While these operations have triggered protests and lawsuits, the objective is clear: prioritizing public safety.
The Political Reality
These legal issues don’t exist in a vacuum. Non-enforcement, sanctuary policies, and open-border rhetoric have real-world consequences—both for public safety and for the integrity of the immigration system.
As I’ve noted publicly, cities like Buffalo that refuse cooperation with ICE make it harder to remove individuals who pose genuine threats.
The goal of my commentary is not political theater—it’s accuracy. Immigration law is complex, but it is not unknowable, and it should not be rewritten on social media to suit ideological preferences.
While sanctuary politicians vilify DHS law enforcement, our officers will continue to arrest kidnappers, pedophiles, and drug traffickers.
