Articles 226, 32 and Tribunalisation have made the Indian bar ignorant of the elementary principles of jurisprudence.

Young lawyers cannot be entirely blamed for their misconception that the constitutionality of a statute or statutory instrument can only be challenged in the High Court and the Supreme Court under Articles 32 and 226, for even lawyers like Mrs. Indira Jaising were under that wrong impression. That was her plea in invoking Article 32 instead of the civil court in the Sabarimala case. Nobody knows today that the true constitutional court is the civil court.
We had a constitutional statute even before the Constitution came into existence, namely the Government of India Act of 1935. There were no writs prior to the Constitution except for the Chartered High Courts of Calcutta, Bombay and Madras. Before 1950, the constitutionality of statutes or statutory instruments came to be challenged before the ordinary civil courts.

Most lawyers are equally unaware that a judgment or decree of a Tribunal, be it an arbitral Tribunal or like that of NCLT or NCLAT, if void, can be challenged before an ordinary civil court. That is because of ignorance of fundamental principles of jurisprudence.
If anyone doubts my humble views, he may read the judgment of the 9-judge constitutional bench in the Mafatlal case, so too Dulabhai by a bench of 5 judges.
An award of a foreign Arbitral Tribunal or a foreign court stands on a lesser pedestal. It can be challenged in an ordinary civil court if it is void ab initio.

जाट, यादव, गुज्जर, वाल्मीकि, व खटीक समाज निरंतर इन सुल्तानों को ठोकते रहते थे ।

अलाउद्दीन खिलजी के अतिरिक्त इनमें से प्रत्येक तथाकथित सुल्तान को मेवाड़ के महाराणाओं ने पराजित करके कुछ को बन्दी भी बनाया था ।

ना इन सुल्तानों ने कुछ बनाया, ना कोई जनहित का काम किया । हाँ, हिंदुओं के सरों की मीनारें बनाना, हिंदुओं को ग़ुलाम बनाकर बग़दाद में बेचना, हिंदू सभ्यता का नाश इनका काम अवश्य था।

आपसे में भी एक दूसरे की हत्या व अपदस्त करना नियम था।

इन डकैतों को सुल्तान कह कर सम्बोधित करना अपने पूर्वजों के हत्यारों की स्मृति पर थूकने जैसा है ।
