Passage of Waqf Amendment Act 2025 by Lok Sabha is Highly Condemnable and a Direct Assault on Religious Freedom and Constitutional Rights: Syed Sadatullah Husaini
New Delhi : Syed Sadatullah Husaini, President of Jamaat-e-Islami Hind (JIH), has strongly condemned the passage of the Waqf Amendment Act 2025 in the Lok Sabha, calling it a blatant attack on religious freedom and constitutional rights .
In a statement to the media, the JIH President said: "The passage of this Act is highly condemnable and a direct assault on religious freedom and constitutional rights in the country. The law is discriminatory, as it erodes the autonomy of Muslims in managing their religious endowments, while religious trusts of other communities remain unaffected. The Act introduces sweeping changes to the Waqf Act 1995, drastically increasing government interference in the management of Waqf properties. This undermines Article 26 of the Constitution, which guarantees religious minorities the right to manage their own religious institutions."
He expressed deep concern over the misleading arguments presented by treasury members during the parliamentary debate. Clarifying a major misconception, he stated that Waqf Boards are not equivalent to the Charity Commissioner, as falsely claimed in the Lok Sabha. He further pointed out that several states have exclusive legislations for Hindu and Sikh endowments, ensuring that regulatory and supervisory authorities belong exclusively to the respective religious communities .
Addressing the purported justification for the Act, he said: “The government has repeatedly cited mismanagement, legal disputes, and misappropriation of Waqf properties as reasons for this amendment. However, the Act contains no concrete measures to address these issues. Instead, adding non-Muslim members and shifting control to government-designated officers will do nothing to solve the problem. In fact, undue political and bureaucratic interference has historically been the primary source of corruption and mismanagement in Waqf affairs."
He also criticized provisions such as altering 'Waqf by User' and imposing restrictive conditions on new Waqfs , calling them deliberate attempts to weaken Muslim institutions.
Expressing his deep disappointment with political parties that claim to uphold secularism yet supported this unconstitutional law , Syed Sadatullah Husaini said:“This hypocrisy will go down in history as the worst example of political opportunism and deception. We urge opposition leaders, secular forces, and legal experts to challenge this Act, which violates Articles 14, 25, 26, and 29 of the Constitution."
He extended full support to the nationwide protests declared by the All India Muslim Personal Law Board (AIMPLB) and other Muslim organizations , emphasizing that: "All legal, constitutional, and democratic means will be pursued to overturn this unjust and unconstitutional law."
