Remember, the Constitution does NOT stipulate the number of Supreme Court justices — that’s set by Congress. It’s been legally changed seven times over the years, with the size of the court varying from six to ten seats.

Since there are currently 13 federal appellate courts, many would argue that it makes sense to expand the Supreme Court to 13 seats. There’s also a broad public consensus that Congress should impose term limits on the court, along with a strict code of ethics for the justices.

Reminder: the Constitution does not specify the number of seats on the Supreme Court. This power was left to Congress, which set the Supreme Court's size at one chief justice and five associates in the Judiciary Act of 1789. It was legally changed seven times.
