The National Guard has a 4-star seat on the Joint Chief's of Staff. US Code Title 10 when on State orders and Title 32 for Federal. A state's military department cuts the orders and manages budgets.

@ZSquabbles @povcops Depending on the state. Some states have stop and ID laws. Others have a law that says you have to ID if trespassed so that there is a record of the trespassed person.

@thenewarea51 Many ways to skin this cat. Assuming alert tanker is unable to takeoff. EADS could look for a tanker to divert (in-service select) from a different mission. Fighters could extend airborne time by recovering at an alternate airfield, yo-yo ops, or SOF could launch spare fighter.
