自分のポストに書いた表現で誤解を招く可能性がある部分についても指摘をしてくれたので、こちらにベンさんが送ってくれた文面を出させてもらいマンチェスターシティについての現状を整理させてもらいたいと思います。

シティに関するベンさんの動画も見させてもらっていたので気を付けながらポストしたつもりですが、表現に誤解を招く部分があったとの事なのでこちらにこの件について知る限り最も理解しているベンさんの説明を本人に許可をいただいたので下に出させてもらいます。

現在シティは下された判断に対し不服申し立てを行っており処分の内容もまだ発表されていない段階なので上の表現にしたのですが、この部分について指摘をしてもらったので今時点での状況について下に出させてもらいます。

以下、ベンさんからいただいた文面になります。

「今回の件は、単なる噂でも、調査中の疑惑でも、違反を申し立てられただけの段階でもありません。独立委員会が証拠を審理し、財務規則違反に関するすべての申し立てについて違反を認定した、法的拘束力のある最終判断が既に下されています。プレミアリーグも、規則上の「final award」と明示しています。

その内容も、契約の実態を偽り、収入を過大に、費用を過少に計上し、監査人や規制当局に財務の実態を隠していたこと、そして規則を回避する明確な意図があったことを、極めて明確な言葉で認定しています。

つまり、「不正があったかもしれない」という状況ではなく、「不正があったと独立委員会が正式に認定している」「なおクラブがその判断を争っている」というのが、現在の正確な事実関係です。

もちろん、シティにはその判断を争う権利があり、実際に不服申し立てを行っています。また、処分の内容もまだ発表されていません。ただ、申し立てを行ったこと自体によって、違反認定が取り消されたり、単なる疑惑に戻ったりするわけではありません。不服申し立ての結果がまだ出ていないことと、違反の認定そのものがまだ行われていないことは、明確に区別する必要があります。」
