*Atenciosamente,*
*O resto do MUNDO.*
*CLAUDIA* *SHEINBAUM*
*PRESIDENTE DO MÉXICO*
The Waorani people of Ecuador secured a major court victory that safeguarded roughly half a million acres of Amazon rainforest from oil development.
The dispute originated in 2012, when the Ecuadorian government carried out consultations in Waorani communities as it prepared to open Indigenous territories to oil companies. Waorani leaders later argued that these meetings failed to provide a real chance for their people to understand the plans or make collective decisions about their land. They reported that the sessions were arranged with little advance notice, used inadequate translation, and presented confusing information. Traditional elders were largely left out, and the environmental and cultural impacts of drilling were never clearly explained.
In 2019 the Waorani of Pastaza took the government to court. A three-judge panel ruled that the 2012 consultation had violated their constitutional rights to self-determination and to free, prior, and informed consultation. The decision nullified the earlier process and blocked the auction of Oil Block 22, an area of about 500,000 acres (202,000 hectares) of Waorani rainforest.
Ecuador appealed the ruling. In July 2019 the Provincial Court of Pastaza dismissed the appeal, rendering the victory final. The judgment did not impose a permanent ban on all future drilling. It simply prevented the government from relying on the flawed 2012 consultation. Any new proposal would have to follow a proper process that respects Waorani rights and decision-making.
The outcome carried wider significance. The same 2012 consultation had underpinned plans for 16 oil blocks covering more than 7 million acres (2.8 million hectares) of Indigenous land, giving other communities a strong legal precedent. A 2025 court review confirmed that no active government project or administrative decision currently involves Block 22, although some of the reforms ordered after the case have been implemented only in part.
By keeping this forest intact, the ruling protects vast stores of carbon, vital rivers, rich wildlife, and the ancestral homeland that Waorani communities have stewarded for generations.
France has introduced one of the world’s toughest environmental laws by criminalizing “ecocide” under its Climate and Resilience Act.
The new legislation allows courts to impose severe penalties on companies and executives responsible for severe and lasting damage to air, water, or soil. Convicted offenders can face fines of up to €4.5 million, or up to ten times the profits gained from the violation, along with prison sentences of up to 10 years.
This marks a significant cultural and legal shift, elevating environmental protection to the same level of seriousness as threats to public safety or human life.
The law is part of a growing international movement, driven by activists, scientists, and legal experts, to treat large-scale ecological destruction as a serious crime rather than a mere business cost.
While some critics worry the law may prove difficult to enforce, it reflects a broader recognition that the health of the planet’s ecosystems is essential to human survival.
Isn’t there anyone in Congress who will step up and demand he follow the rules? All these projects should require Federal approval. He is not the landowner; the American people are.
