This book takes that record seriously more seriously than the courts, the academy, or the federal government ever have. No euphemism, no charitable reading of intent, survives contact with the primary sources assembled here. Reinforced by halachic jurisprudence’s precise vocabulary for inherited injury and by game theory’s account of why the evasion has proven so durable, the argument is relentless, exhaustively cited, and built to withstand the strongest objections its critics can raise because it engages them directly, on the record, before dismantling them.

The Introduction establishes the ethno-genesis of Foundational Black America (FBA) through three sequential founding moments.

The first is the Middle Passage and arrival on American soil as cargo under law—the constitutive rupture that converted diverse African peoples into a unified legal status of property.

The second is the Virginia statute of 1662 codifying partus sequitur ventrem “the child follows the condition of the mother”, which transformed slavery from a personal condition into a hereditary one transmissible through the maternal line in perpetuity.

This statute is treated as the jurisprudential foundation of the FBA remedy class: if the injury was imposed genealogically, the repair obligation must be genealogical.

The third founding moment is the Reconstruction Amendments themselves, which constitutionalized the formerly enslaved and their descendants as a juridical class with affirmative standing.

The legislative debates of the 39th Congress are quoted at length: Senator Lyman Trumbull’s “freedmen and their posterity,” Representative Thaddeus Stevens’s “debt of justice” owed to those “oppressed for generations and to their posterity,” and Senator Jacob Howard’s enforcement mechanism reaching “discriminations which directly flow from the condition of slavery.”

The Introduction then delivers the three-element juridical definition of FBA status: (1) documented direct descent from at least one person legally classified as enslaved under American colonial or state law prior to the Thirteenth Amendment; (2) legal-status traceability through primary sources (Slave Schedules, Freedmen’s Bureau records, manumission instruments, plantation inventories, Freedmen’s Savings Bank records, or comparable documentary evidence); and (3) continuous American presence from emancipation to the present. DNA evidence may supplement but never substitutes for documentary evidence.

I am been doing my family history ( mostly of my family is directly From Slave Owen, , Mulatoo and Negro) her Newton and Jasper county South east Texas family since 1980. My parents born 1930s we started - my family start Negro Free community here in Newton County.. my family goes back to 1840 the Texas Ashworth Act the Negro passing white, Texas said get out or go into slavery

When FRFT conducted the Copper Color test, we did not test the Australian Aborigines. Those proteins live in the skin. This is why testing different African tribes showed no copper undertones.

@arthurwatkins that D1 MTDNA haplogroup is my 4th great grandmother D1 that was passed to her daughter. The classified her as white her children my 3rd great grandfather Rubien as Mulatoo.
