Jane, a ranking member of and sixteen year veteran of the U.S. military, was devastated when informed by her superior and a Master Sergeant that a sex video of her and her husband was trending on P*rnhub.

The video, which Jane never consented to filming and did not even know existed, had been secretly recorded two years prior by her husband. By the time Jane discovered the video, it had been on P*rnhub for over a year and had nearly half a million views and a download button.

Mortified and concerned about the career implications, Jane immediately contacted P*rnhub demanding the video be taken down. Six days passed before Pornhub finally responded. All the while during each hour that passed, 5 million site visitors had the option to view and download Jane’s abuse.

When P*rnhub finally responded, instead of removing the criminal content, P*rnhub hassled Jane. They demanded that she prove it was her in the video and asked “how do you know this is you?”

Furious, Jane said “That is my bed . . . that is my face, my voice, THAT IS ME.” P*rnhub proceed to finally deactivate the video but it failed to take down the site page, which continued to be accessible through google searches and drive traffic to the site. It took countless additional demands, before the page was finally removed. But, as P*rnhub confirmed in writing, the video was only removed from that one MindGeek/Aylo site.

Due to P*rnhub’s policies concerning automatic uploading of content to its affiliated tube sites, in the 14 months the video was on P*rnhub, it had been reuploaded to countless other websites. After days of unsuccessful efforts to reach out to each of these sites individually, Jane was forced to hire a takedown company, at a substantial cost, to assist her with attempting to remove all of the illegal videos from the internet, each of which originated from the video posted on P*rnhub.

She then learned through online searches that her now-ex-husband had also posted a second video of her (which she likewise did not previously know existed and did not consent to), on P*rnhub.

After further investigation, Jane learned that her ex-husband had posted dozens of nonconsensua videos of himself engaging in sex acts with other women to P*rnhub.

Jane’s ex-husband was then criminally charged for what he did.

Her concerns about career implications from the video proved to be well-founded. In the days after the video
was discovered, Jane was put on administrative leave and disciplinary action was taken against her. This was, the first and only time this occurred in her sixteen-year career. Her monthly stipend was revoked and Jane was
required to step down from a leadership role she held for five years on one of her employer’s committees.

In addition to the economic harm, Jane continues to suffer significant emotional harm, including anxiety and panic attacks for which she is now receiving treatment under the care of a psychiatrist and a therapist. Jane also faces harassment from her neighbors and others her community because of the videos.

Jane sued P*rnhub in California federal court in 2021.

Here is a small sample of evidence we have about P*rnhub’s complicity:

-The CEO/owner admitted in emails that they did not verify the age or consent of any of the millions of individuals in the homemade user generated sex videos on the site.

- They regularly ignored victims who were begging for their abuse videos to be taken down.

-When they did respond to victims they would hassle them to prove they were victims in the videos.

-Legal filings show they also ignored police demands to remove criminal abuse on multiple occasions.

-If videos were removed they would just get uploaded again and again.

-They employed only 10 moderators per 8 hour shift for all of MindGeek/Aylo’s tube sites including P*rnhub, Redtube,YouPorn, Xtube and more.

-Moderators were reprimanded if they watched less than 700 videos per shift and were expected to watch up to 1200 with the sound off. Some of the more experienced moderators would skip through over 2000 per shift.

-Multiple whistleblower moderators have come out and said their job was not to remove content, it was to allow as much content to go through as possible.

- On September 1, 2023 text messages that were uncovered in legal discovery were published by the court where MindGeek employees said “The problem is that management does not want the rules enforced.”

- Legal discovery proved Pornhub had only one person employed 5 days a week to review flagged videos.

-They had a backlog of 706,000 flagged videos.

-They had a policy not to even review a flagged video until it has over 15 flags.

-A victim could flag their criminal abuse 15 times without ever triggering a review of the video.

-The CEO called their flagging policies “good and reasonable” in emails.

-The CEO admitted in emails it was “obvious” that they were “trying to hide” their policies from the credit card companies.

-In June and July 2023 senior manager Mike Farley of MindGeek/Aylo/P*rnhub was caught on hidden camera by undercover journalists admitting that company owners and executives “don’t care” that illegal content is easy to upload and monetize on P*rnhub. He said when he confronted the CPO about these policies that enable sex crimes to be uploaded and P*rnhub to profit from them, he was told to “shut up” and “f*ck off.” When asked if criminal content is still uploaded to P*rnhub today, Farley said “of course.”

All of this was intentional company policy and practice. These were all decisions made by the owners and executives.
