शासकीय कर्मचारी का RTI अधिनियम के तहत जानकारी माँगना सिविल सेवा आचरण नियम के विरूद्ध कृत्य नहीं है। अगर आपको RTI आवेदन दायर करने के लिए धमकाया गया है तो प्रमाण सहित सूचना आयोग के समक्ष शिकायत दर्ज करवा सकते है।

सूचना आयोग के अलावा धारा 20 के तहत दोषी अधिकारी को दंड देने का अधिकार किसी भी अन्य अधिकारी या प्रथम अपीलीय अधिकारी को प्राप्त नहीं है। वही प्रथम अपीलीय अधिकारी को दंड देने का प्रावधान भी RTI कानून मे नहीं है।

This is gender discrimination. Law should not promote such baises. Moot question : If husband's salary disclosure is warranted under RTI for settling case under section 125 CrPC then why not on similar ground wife's lT returns should also be disclosed for a fair disposal.

@prakash52kar Why anyone should shy from mentioning PIO on the envelope. If the PIOs refuse to receive the post then let them face the music. As per the Act PIO cannot refuse to accept RTI application. I have earlier penalised such PIOs & would continue to do so.

To stop misuse of RTI Act provinding as much info as possible under Section 4 of RTI Act on a public platform suo moto is the easiest solution. So public need not file RTI. Will those alleging misuse dare to do it? Public authorities are blatantly violating sec 4. @LiveLawIndia
