ANALYSIS:🧐A federal judge blocked the Trump administration’s policy that suspended immigrant visa issuance for applicants from 75 countries🏦

On August 21, US District Judge Jeannette Vargas ruled that the State Department policy exceeded Secretary of State Marco Rubio’s authority because federal law does not allow immigrant visas to be categorically denied based solely on nationality👩‍⚖️

Five days later, the State Department announced a temporary pause on immigrant visa appointments worldwide while consular officers receive new training on public-charge screening🏛️

The department said appointments would be adjusted while officers learn updated procedures for determining whether applicants may become dependent on government benefits. This applies to immigrant visa appointments, not every tourist, student, or other nonimmigrant visa👳‍♂️👳‍♀️👳🧕

Supporters of the administration say the government has broad responsibility to protect taxpayers, carefully screen people seeking permanent residence, and make sure immigration rules are applied consistently around the world📜

They may also view the worldwide pause as the administration finding another lawful way to carry out stricter screening after losing the 75-country policy in court⚖️

Critics say the original 75-country policy unfairly restricted legal immigration based on nationality, and they argue that the new worldwide pause could create even larger delays for families waiting to immigrate legally👨‍👩‍👧‍👦
