There are Laws governing the nation and you don't need to necessarily lodge a complain before the laws come into force.
You are a former veep for that matter.

1. The prospect of a regional opposition party boss ("Chairman Wontumi") getting a plea bargain over a financial crime case has set many tongues wagging in Ghana.
2. The government's case against the Chairman is that while the party in which he is a regional boss was in power, his company took GHยข14.3 million from a state-owned "development bank" (EXIM) for a large-scale commercial farm sometime in 2018. Failure to service has ballooned the loan to GHยข30 million.
3. However, they bought no agricultural plant or machinery. They employed no one to work on the farm. They did not own or secure the 100,000 acres of land which they represented to the Bank as a parcel of land secured for the proposed farm.
4. More curiously, one of the documents presented as a board resolution letter was dated January 23, 2018, but referred to a resolution supposedly passed on December 9, 2017 (four days before the company was officially incorporated on December 14, 2017.)
5. It is on this basis of the foregoing that the government decided to prosecute for fraud.
6. The plea bargaining application is under Act 1079, passed in 2022. Until that law, Ghana had somehow meandered around for 60+ years without a clear and consolidated plea bargaining law.
7. Even more curiously, there were scattered provisions in Act 30, the Courts Act (459), the OSP Act, the Narcotics Act, & across the law that prosecutors often relied upon to grant terms similar to plea bargaining outcomes.
8. Since the plea bargain act was passed in 2022, the discretion of the Attorney General (AG) has been hard to fathom.
9. In the ambulance saga featuring the current Finance Minister (then in opposition) that I took a lot of interest in, the AG then totally refused to accept the reimbursement offered by the ambulance dealers in exchange for a plea bargain without any public explanation.
10. I know I sound like a broken record, but only Katanomics adequately explains the constant public anxiety and confusion about how power is wielded in situations like this in Ghana.
11. Katanomics says that in a healthy democratic society, norms should progress according to this sequence: politics โ policy โ law โ constitution. The law must only codify what policy contestation (through debate, acrimony, and elite consensus) has refined for broader public understanding.
12. Laws should emerge only when policies become stable through iterative learning. That is how they attain their legitimacy.
13. Regarding plea bargaining in Ghana, where is the product of genuine national learning? What has the country learnt through the various scattered use cases since 1960?
14. How did we arrive at the list of exemptions and inclusions of crimes for which plea bargaining is possible or not?
15. How did we conclude that plea bargaining under Act 1079 should be available for crimes committed before the law's passage in 2022?
16. On point 14 again, how did we conclude that if someone sells alcohol near a polling station, defaces an EC notice, or displays their ballot publicly before putting into the box (i.e. commits an "election-related" misdemeanour), they should be denied plea bargaining but someone that commits the felony of embezzling funds for a major highway can benefit?
17. Is it not clear that the law is the disorganised product of a system with zero NATIONAL LEARNING, the very foundation of the katanomic condition?
18. And that the elite system as a whole is katanomic from head to toe? It is easy to make this about a certain Chairman Wontumi. But only because thinking through what is truly broken in the system requires folks to commit to a level of critical effort they haven't bargained for in accepting the citizenship of Ghana.
