Let me state these again for people who do not know or who might have been misguided:
1. A police man or EFCC officer does not need to have concluded investigation before an arrest can be made. What is required is a reasonable suspicion that prima facie, a crime has been, is being or will be committed by the suspect.
2. In fact, a private person can effect an arrest for the same reason above, but must immediately hand over the suspect to the police for proper investigation.
3. Also, it is not in all cases that a warrant of arrest must be obtained before an arrest can be carried out. At least, there are about 5-10 known instances where an arrest can be made without a warrant. The legal burden is only on the person making the arrest to inform you of the reason for the arrest within 24hours and in writing.
4. The law also permits or allows anyone effecting an arrest, with or without a warrant, to break in through the door or window, where the resident has been informed of the presence of the security agents but refuses to open the door for access.
5. When you receive a police or EFCC invitation, either through WhatsApp, text or phone call, do not ignore! They do not need to necessarily bring it to your house and deliver it to you in person. As long as it gets to you, make sure to attend, but with a lawyer.
6. When honouring invitations, do not go alone, for there is a higher chance that your rights will be violated. The presence of a lawyer eliminates or prevents that possibility. But don’t refuse to honour an invitation. It’s also not advisable to go on a Friday, because it’s usually a short day and before you finish, you might not be able to perfect your bail that day. So till Monday.
7. Anyone telling you otherwise is either lying to you or wants you to languish in jail for their self-aggrandisement. Because refusing an arrest too is also a crime on its own.
