Today's 90-Day suspension of Distinguished Senator Natasha Akpoti-Uduaghan by the Nigerian Senate led by Senate President Godswill Akpabio is unconstitutional, null and void.
The allegations of sexual assault brought before the Senate by Senator Akpoti-Uduaghan against SP Akpabio haven't even been deeply investigated by the Ethics Committee of the @NGRSenate. Assuming that the case is before the courts, thus, subjudice for the Senate to investigate, it does not call for the scandalous suspension of Senator Natasha.
Contempt of the Senate is the only reason provided by the Senate Rules to discipline an errant member.
In the case of Omo Agege vs. Nigerian Senate, & ors. (2018), Justice Nnamdi Dimgba of the Federal High Court Abuja ruled that Senator Ovie Omo-Agege's 90-Day Suspension and stoppage of salaries by the Senate President Bukola Saraki-led Senate was "in gross violation of Order 67(4) of the Senate Standing Orders 2015, and Section 21(2) of the Legislative Houses (Powers and Privileges) Act, which prescribe an upper limit of 14 and 1 legislative days respectively for the suspension of an errant member.”
...and codified by Parliament via legislation and/or constitutional amendment. In other words, the judiciary has no authority to interfere with political questions, which are entirely the realm of Parliament and the executive.
