Here comes the BIG News—— where wives are in adultery and then claiming maintenance for the child outside marriage .

The Supreme Court has ruled that DNA paternity tests can be allowed in matrimonial disputes, but only when determining paternity is central to the case and there is no other effective way to establish the truth.

The court made this observation while hearing a matrimonial dispute matter, questioning why a person confident of their loyalty would object to such a test. At the same time, the court made it clear that these tests cannot be ordered routinely or simply based on an allegation.

It said courts must first look at the evidence already available, keep in mind the legal presumption that protects children born during a valid marriage, and respect the privacy and dignity of everyone involved before allowing such a test.

Filing a DV case doesn't automatically entitle wife to maintenance, especially if she earns more than husband, Karnataka High Court

The Karnataka High Court has held that merely filing a petition under the Protection of Women from Domestic Violence (DV) Act does not automatically entitle a wife to interim maintenance. The Court ruled that where a wife is financially independent and earns substantially more than her husband, maintenance cannot be granted as a matter of course.

The case arose after a trial court directed the husband to pay ₹20,000 per month as interim maintenance under the DV Act. Challenging the order, the husband argued that while his monthly salary was around ₹60,000, his wife was employed in a private company earning over ₹1 lakh per month, making her fully capable of maintaining herself.

Examining the affidavits of assets and liabilities, the High Court found that the wife had disclosed an income of ₹1 lakh per month, while tax records showed her actual monthly salary to be around ₹1.64 lakh. Although she claimed to be repaying loans taken for the marriage, she neither disclosed these liabilities in her affidavit nor produced any supporting documents.

The Court observed that the trial court had considered only the husband's income while completely ignoring the wife's admitted earnings. It stressed that maintenance proceedings require a fair assessment of the financial position of both parties, and not merely the husband's obligation to provide support.

The High Court clarified that maintenance—whether interim or final—is justified only when the wife establishes that she lacks sufficient financial resources to maintain herself in a manner consistent with the standard of living enjoyed during the marriage. It emphasised that filing proceedings under the DV Act, the Hindu Adoptions and Maintenance Act, or the CrPC does not automatically result in an award of maintenance.

Accordingly, the High Court set aside the order directing payment of ₹20,000 per month as interim maintenance, while clarifying that its observations were confined to the interim stage and would not affect the final adjudication of the main domestic violence proceedings.

🚨Watch | A Zomato customer in Kolkata exposed an alleged fake delivery using footage from his home’s CCTV camera.

The delivery partner marked the order as delivered and uploaded a photo claiming it had been left at the gate.

However, the CCTV recording reportedly showed the order was never delivered.

This is the power of social media. An elderly man went to file a complaint at the Bichhiwara police station (Dungarpur district) in Rajasthan.

There, he met a police constable by the name of Reena Garg, who seemed uninterested in his complaint.

Thereafter, in a bizarre display of unprofessional behaviour, the constable placed both of her feet on the table.

This was done in complete disregard of basic etiquette towards an elderly individual.

Fortunately, someone at that police station took a picture of Reena and posted it on social media.

And the Rajasthan police was forced to take cognisance.

Dungarpur SP Manish Kumar acted swiftly and suspended the disgraced cop.

The police are appointed to serve the public. But this viral image shows how some entitled cops behave when they are supposed to serve the people's interests.
