Lumalalim pa ang kontrobersiya sa umano'y pagtakas ni Sen. Bato Dela Rosa mula sa Senado matapos sampahan ng reklamo sa Office of the Ombudsman sina former Senate President Alan Peter Cayetano, Sen. Robin Padilla, at suspended Senate acting Sergeant-at-Arms Mao Aplasca.

Ayon sa Tindig Pilipinas at iba pang civil society groups, maaaring managot ang tatlo sa kasong Obstruction of Justice dahil umano sa kanilang mga aksyon na nagbigay-daan para makatakas si Dela Rosa sa gitna ng tangkang pag-aresto sa kanya ng mga awtoridad.

Partikular na tinutukoy sa reklamo ang desisyon ni Cayetano na ilagay si Bato sa "Senate protective custody," ang umano'y pagtulong ni Padilla sa paglabas ng senador mula sa Senado sakay ng kanyang sasakyan, at ang umano'y pagharang ni Aplasca sa mga operatiba ng NBI habang umiinit ang tensyon sa loob ng Senado.

Matatandaang nagkaroon pa ng barilan noong May 13 sa pagitan ng mga tauhan ng Senate Sergeant-at-Arms at NBI agents na may dalang warrant laban kay Dela Rosa. Inamin mismo ni Aplasca na siya ang nagpaputok ng warning shot, na sinagot naman ng putok mula sa panig ng NBI.

Pagkatapos ng kaguluhan, nakalabas si Dela Rosa sa Senado at muling nagtago ng ilang panahon. Ayon pa kay CIDG Director Maj. Gen. Robert Alexander Morico II, ang pagtakas umano ni Bato ay "hindi mangyayari kung wala si Robin Padilla."

Depensa naman ng mga naghain ng reklamo: hindi maaaring gamitin nina Cayetano at Padilla ang parliamentary immunity dahil ang isyu ay hindi tungkol sa kanilang mga talumpati o debate sa Senado, kundi sa mga umano'y aktwal na kilos na maaaring nakahadlang sa pagpapatupad ng batas.

Kung uusad ang kaso, isa ito sa pinakamalalaking legal na hamon na haharapin ng mga pangunahing kaalyado ni Dela Rosa sa gitna ng patuloy na political at legal fallout mula sa kanyang kontrobersyal na pagtakas mula sa Senado.

Sen. Ping Lacson questioned Sen. Alan Peter Cayetano's position in a post on X on Sunday, June 7, amid the ongoing leadership dispute in the Senate.

“The Executive Department, House of Representatives, Integrated Bar of the Philippines, law deans, law professors, former Senate presidents and many others do not recognize Senator Alan Cayetano as the President of the Senate. So, what is he?” Lacson wrote.

The post comes days after the Integrated Bar of the Philippines declared the June 3 Senate reorganization by a 12-member quorum “lawful and valid,” citing the 1949 Avelino v. Cuenco ruling.

Former Senate presidents Franklin Drilon and Aquilino Pimentel III have also backed the move that installed Sen. Sherwin Gatchalian as Senate president pro tempore and acting Senate president.
