Over the past decade, multiple investigations and audits have revealed significant fraud and cost inflation in the LIHTC program, with developers inflating construction expenses (often through kickbacks or false invoices) to claim excess tax credits and divert millions of dollars from intended affordable housing funds .
Excessive developer fees, protracted approval timelines (often twice as long as for market-rate projects, driving up legal and transaction costs ), and other inefficiencies (like complex syndication processes that can consume 10–27% of project equity in transaction costs ) have driven LIHTC development expenses far above market norms – roughly 20%–30% higher per unit than comparable private projects – with median LIHTC development costs around $204,000 per apartment and some projects exceeding $600,000 per unit.
These inflated costs and abuses mean that a large share of the subsidy is captured by developers and intermediaries instead of lowering rents for tenants, contributing to LIHTC rents rising faster than typical market rents (often hitting maximum-allowable levels and unaffordable to the lowest-income households) ; in response, HUD imposed a new 10% cap on annual rent increases for LIHTC properties to curb above-market rent hikes.
