Another SCOTUS ruling, another round of strong, emotional reaction. Please read both the ruling and the case that was brought forth. Please respect opposing views. I agree with this ruling, I believe it’s the correct ruling, but I respect and will respectfully listen to opposing viewpoints on this. A few thoughts:

1. Affirmative action is racial discrimination. It just is. Now you may believe it’s justified discrimination. You may believe it’s positive discrimination. You may believe it’s discrimination that’s okay because it’s correcting for centuries of racial discrimination against black Americans. But it IS racial discrimination regardless, and if you support it, you must acknowledge and defend why this discrimination is justified.

2. Title VI of the Civil Rights Act of 1964 - “No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.”

In other words, we can not and must not discriminate on the basis of race.

3. But we HAVE discriminated on the basis of race against black Americans since our founding. So what do we do about that? Most all of us want to live in a color blind society. But we don’t live in a color blind society. We don’t yet, and way too many people on the right don’t acknowledge this and don’t acknowledge the systemic racism that still exists, and they want to believe we can just snap our fingers and move beyond the impact of centuries of slavery, Jim Crow, and discrimination against black Americans. We can’t.

4. But this ruling appropriately makes clear that universities can no longer discriminate on the specific basis of race in its admissions. It’s the correct ruling.

5. A diverse campus IS vital, so colleges & universities must pursue other programs and policies, other recruitment & scholarship programs, and use other admission tools, to achieve a diverse student body.
