@legalbytesmedia Admittedly, I practice in the Ninth Circuit (which is very anti-SLAPP friendly). Based on that case, I was incorrect that they could move under CA’s law. But I think it’s entirely possible that some (if not all) of NY’s law could very well still be in play in this case.
@legalbytesmedia That absolutely is how it works. Maybe they’d bring it under NY (or other state) law instead of CA bc it may be separate from the contract but federal courts decide anti-SLAPP motions all the time. And I say that as an attorney who has won an on anti-SLAPP motion in federal court
