Hunting BAN: Modern hunting rifles and shotguns are targeted — Hawaii hunters will lose many of their tools.
Shooting Range BAN: SB401 says you can only use banned guns at "licensed" shooting ranges — but Hawaii licenses NO shooting ranges, meaning you’ll have nowhere to legally shoot them.
Inheritance Restrictions: Heirs must disable, sell, or remove banned firearms unless specific conditions are met.

Class C Felony (5 years in prison, no probation) for possessing banned firearms.
Felony or misdemeanor for having banned magazines, depending on use.

The language banning these firearms was never given a single hearing in the Senate.

Hawaiʻi lawmakers are moving forward with SB401 HD1, a drastically expanded gun control bill that no one in the public has had a chance to testify on. This isn’t just about gun policy — it’s about fair process, public trust, and constitutional integrity.
🔍 What’s Going On?
SB401 originally proposed a ban on .50 caliber firearms — a short, clear bill (460 words).
On March 13, the House gutted the original bill and replaced it with language from a totally different bill (HB893), expanding it into a broad assault weapons ban.
The new version is over 2,600 words long and includes:
A ban on all semi-automatic rifles with detachable magazines
New definitions like “assault rifle” and “fixed magazine”
Magazine capacity limits, transportation restrictions, new penalties
The committee report still falsely says it’s just about ".50 cal" firearms.
And worst of all? The public has never been allowed to testify on the new version.
⚖️ Why This Matters
This kind of "gut and replace" tactic was ruled unconstitutional by the Hawaiʻi Supreme Court in 2021 (League of Women Voters v. State).

The governor signed HB 2342 into law. This makes the carrying of all deadly and dangerous weapons perfectly legal. The law makes it so that as long as a person is openly carrying any type of weapon, including switchblades or butterfly knives, they can do so.
If you see somebody walking down the street and they are openly carrying any kind of weapon that’s not a firearm. They are not breaking the law.
You should call the police unless they are acting in an erratic manner posing a danger to themselves of our property. The mear possession of arms is not a crime.
