ANOTHER VICTORY FOR THE CONSTITUTION AND THE PEOPLE OF KENYA

Fellow Kenyans,

Today, the High Court has reaffirmed a simple but powerful constitutional truth. Public office is not a shield against accountability. Public information belongs to the people, and every State officer has a duty to uphold transparency, accountability, and the rule of law. The court found that my constitutional right to access information held by the Busia County Government had been violated. Judgement in Omtatah v @HonOtuoma issued on 27.07.2026 by the High Court at Vihiga. NO PUBLIC OFFICE IS ABOVE THE CONSTITUTION

This case has never been about personalities. It has always been about protecting public resources, defending the Constitution, and ensuring that no public institution operates in secrecy. The judgment sends a clear message that openness, public participation, and constitutional governance are not optional. They are legal obligations.

I welcome this decision as a victory for every Kenyan who believes that public power must always remain subject to public scrutiny. Our commitment to defending the Constitution remains unwavering. The IMF/World Bank immunity law @OkiyaOmtatah is challenging was passed in Dec 1963. Right at independence, the colonialist refused to return expropriated land in the White Highlands to Kenyans for free. Foreign entities used loans to ensalve the then young Kenya. Loans whose purpose was to buy back land from European White settlers.

The then govt went ahead to use this funds to hand prime farm land to themselves and political elites, and left Mau Mau & Wanjiku with the bill. The 1963 Act ensured the lenders could never be sued in local courts. This is why this petition targeting the core of that neocolonial design and sovereignty is essential to us freeing ourselves from the economic shackles
The princeling then stole through the same laws to develop the farm land.

In short, our granddads fought for the land, our parents bought the land and we developed the land for that one single family

The owner Hassan is said to have been attacked by goons on his his way home last week where he identified one of them.

He decided to press assault charges on me criminal he identified nicknamed Abbas who is leading a dangerous and notorious bodaboda gang in Kisii that has been nicknamed Green Army.

This morning, the gang, using County Government garbage tracks they transported garbage and raw sewage, poured it into this premise in broad daylight, gave death threats to the staff and left.

The gang works and is being protected by Kisii County outgoing governor Simba aRat. This is the level of IMPUNITY and LAWLESSNESS in this country!

Back in Kisii, I am told you can't report any member of this gang to anh law enforcer since they won't arrest them. What else do citizens have than to take the law into their hands and protect themselves?
