In 1950, no other country attempted many of the things India attempted simultaneously, at continental scale, and at birth. Here are 5 aspects of our constitution that were far ahead of their time
1. Universal adult franchise from day one :India gave every adult citizen the vote at independence, regardless of literacy, property, gender, caste, or income.
2. A Constitution for extreme diversity, not a nation-state ideal: Most constitutions assumed cultural homogeneity. India did the opposite.The Constitution recognised linguistic pluralism,allowed asymmetric federalism,
permitted different personal laws and embedded minority protections deeply.
3. Fundamental Rights with judicial enforcement India combined enumerated Fundamental Rights, direct enforceability through courts and the power of judicial review was explicitly recognised.
4. Directive Principles of State Policy (DPSPs) :India constitutionally separated
justiciable rights (courts can enforce) from Non-justiciable obligations (moral and political duties of the state).
This created a long-term constitutional roadmap for social justice without judicial overreach. No earlier constitution had institutionalised this dual-track model so cleanly.
5. Constitutional abolition of “untouchability”:Article 17 didn’t merely outlaw discrimination; it abolished a social system, not just a legal practice.This was radical as no other constitution had criminalised a millennia-old social hierarchy at founding
