@EWess92@X@elonmusk Glad we agree Claiborne establishes a social justice exception to antitrust liability (if you are boycotting for social justice reasons, you are immune under Clairborne!). Wish you the best as well, just try not to distort the law to your uninformed followers in the future!
@EWess92 Judge Bove, for example, must recuse from any immigration case under Eric’s asinine understanding of judicial ethics. Not sure he even thought this one through!
@EWess92 Wow! If recusal was required for “advocacy in the issue area,” Eric’s favorite judges would have no cases to hear! They are all partisan litigators from DOJ/state SGs. Goes to show that Eric is as bad on legal ethics as he is on ethics ethics.
@teafortillerman@HughLouisDewey Again, still waiting. BTW, another order finding blatant and repeated noncompliance by the Admin. https://t.co/YmswJoVG8N
@HabCorpLinguist And for the love of god, I don’t think that the “lib” argument is a good one! Gender transition to likely have much higher complication rates than boob jobs, and so they aren’t analogous. But it’s a bad argument to deny that some affirming cosmetic tx are acceptable socially
@HabCorpLinguist Cosmetic surgeries focused on features associated with masculinity/femininity are obviously gender affirming. But not all cosmetic surgeries are! Removing burn scarring has nothing to do with enhancing features associated with masculinity/femininity (my original point).
@HabCorpLinguist Yes, that is exactly what I think! Look no further than this site itself. Men will publicly post that they are getting transplants to restore their masculinity and/or attract women (by promoting the perception that they are masculine). This isn’t controversial.
@Ejmiller25@HabCorpLinguist Completely besides the point (which is to only highlight that gender affirming procedures are tolerated in some cases). I wouldn’t want you handling my appeal with your reasoning (in)ability!
@thebitterlesson@HabCorpLinguist Of course it does! But no one gets facial reconstruction surgeries due to IED injuries to “affirm” those gendered features…don’t be daft. Just make better arguments!
@GeorgeGgraff48@HabCorpLinguist Really? I didn’t realize that men love lip filler so much! Can’t wait for the next lip care line from Brad Pitt to launch.
@EWess92@TheJusticeDept Totally unpersuasive analysis that barely confronts the primary exception (for hunting). No court will adopt this motivated reasoning masquerading as “analysis.” Sad!
@LilBeanDip5012@EWess92 Again, you have 0 idea what you are talking about. An appellate court can lack jurisdiction now to review an interlocutory decision, but that does not mean they will not have jurisdiction later once the action results in a judgment. Please work on yourself before commenting.
@LilBeanDip5012@EWess92 Can you read? I never said SCOTUS would overturn this CA5 decision (which does not deal with the merits of the d.ct opinion). I said Judge K will be reversed on the merits, which is true more often than not historically (look at his reversal rate — sad!)
