Yes, asylum seekers are in the country legally. The current law in the U.S. allows any noncitizen, whether or not they have a valid visa, to enter the country and claim asylum. This holds true regardless of one’s legal immigration status.

In his statement today defending his executive order, Biden said, “I say to you be patient and the good will of the American people is wearing thin right now.” That’s true, in part, because Biden failed for so long to push back against GOP demonizing of asylum seekers.

I am simply refusing to post anything more about this executive order until someone can tell the public what will actually start happening at the border in terms that do not imply the president has magic powers.
If this law doesn't guarantee the right to apply for asylum, no law guarantees anything. Explain to me how Congress could have been clearer about the right to apply for asylum regardless of circumstances....
