This is Watson v. RNC — argued at the Supreme Court today. The question: does federal law require ballots to actually reach election officials by Election Day, or is dropping a ballot in a FedEx box close enough?

Justice Gorsuch identified the contradiction at the heart of Mississippi's argument and refused to let go of it. Mississippi's brief repeatedly said ballots must be "submitted to election officials" by Election Day. But they also argued that handing a ballot to a common carrier — FedEx, the Postal Service — satisfies that requirement.

Gorsuch's response: those two things don't add up. 𝘍𝘦𝘥𝘌𝘹 𝘪𝘴𝘯'𝘵 𝘢𝘯 𝘦𝘭𝘦𝘤𝘵𝘪𝘰𝘯 𝘰𝘧𝘧𝘪𝘤𝘪𝘢𝘭.

Then he dropped the hypothetical that made everyone in that courtroom uncomfortable. Imagine a state where a large portion of voters mail their ballots on or near Election Day. The day after the election, a bombshell story breaks — a candidate's scandal, or evidence of collusion with a foreign power. The losing candidate urges voters to recall their ballots. FedEx will do it — you can call and cancel a delivery. And it swings the election.
