UPDATE: Along with the lawsuit, the Justice Department also filed a settlement agreement in which Activision Blizzard (@ATVI_AB) agreed to drop the cap. The settlement agreement must be approved by a federal judge.

The 1st round of appeals goes to the same commission. Illumina plans to further appeal to fed court

@JusticeATR@Law360 DOJ only started pursuing these kinds of cases criminally in last few years, after previously pursuing them with civil charges that don't come with jail time. Their only wins have come from guilty pleas and a jury that convicted on lying to investigators, NOT antitrust charge
