Today, the NY Appellate Court granted a TRO in the lawsuit brought by VTA, Benevolent ELiquids & Perfection Vapes to halt tomorrow's enforcement of the flavor ban. The panel unanimously ruled that the State is “temporarily enjoined and prevented from enforcing” the flavor ban.

If a product contains THC, it’s not an e-cigarette. An e-cigarette is a term of art under existing regulations, it’s an electronic nicotine delivery system (ENDS) and is a deemed tobacco product. A device specifically for vaping THC is illegal under federal law, and not an e-cig.
