@jayslayerjay66 yes they could have. the problem is the precedent: "OK to infringe first, then ask later." as in another business could see valve working a deal with dbrand after the fact, will also try to rip off Valve's IP until Valve intervenes as they think "if dbrand did that, why can't we"
