@holly_pierson@mitch_dog34 My reference was to Justice Warren ruling in favor of her pal, Justice Blackwell. Again, she should have recused. Says a great deal about her approach to conflicts, actual or apparent. And the reference is to Blackwell contributing to the Warren campaign.

@noahpines Evidently Justice Warren’s conduct is such that she has a warped view regarding recusal. 1991 case - Smith v Miller involved a colleague. All recused. Guess Melton, Nahmias and Warren were too concerned for Blackwell to leave it to chance.
@noahpines Bethel recused. Why not Warren? Involved their colleague. Appearance of conflict if not actual conflict. Oh, and Blackwell subsequently donated to Justice Warren. She can say why she didn’t recuse and whether, if she loses, she will trigger the loophole she helped create. /1

Whether incumbents like it or not, there will be campaigns which by definition entail protected speech. I thought MAGA folks respected the First Amendment.

I believe the case was dismissed as moot because the challenge specified what the JQC was alleging. So if you are going to challenge the Star Chamber’s attempt to restrict free speech, you have to do so under seal.
@noahpines@IvxnIvxn You don’t get more partisan than that! The dissent highlighted a “staggering loophole” – Warren loses, resigns, and creates a vacancy, which btw she could be appointed to fill. Why didn’t she recuse? Why won’t she say she won’t avail herself of the loophole she helped create?
