That choice is not the same as the claim that all servers have to pay taxes on 8% of sales. I agree that it’s fair for tips to be based on a % of sales.

It’s to discourage servers from under-reporting tips. Many would rather pay the difference than keep records, which is a choice.

The right way to “fix” this bill would have been to subtract the fee from the total before sales tax and recalc the sales tax to arrive at the total.🧮
