2. Log In

* Click Login on the homepage.
* Enter your registered email address.
* Request an OTP.
* Enter the OTP to access your dashboard.

3. Complete Your Profile

Fill in the following details:

* Citizenship (Kenya or Other Country)
* Full name (as it appears on your National ID)
* Email address
* Date of birth
* Phone number
* National ID number (for Kenyan citizens)
* Profile photo (optional)

I once heard someone coin the Word JURIS PESA not JURISPRUDENCE……..JURIS PESA and I can’t shake off that feeling of something haunted tonight.

The 3-Judge Bench in the impeachment case of H.E Rigathi Gachagua has left us with a serious constitutional question.

The Court found that his right to a fair hearing was violated.

Yet it declined to quash the impeachment and instead awarded damages.

This is where the tension lies.

If a constitutional process is found to have violated Article 50 (fair hearing) , a right that is foundational and non-derogable , how can the very product of that flawed process still stand?

A fair hearing is not a technicality.
It is not cosmetic.
It is not optional.

In impeachment proceedings , which are quasi-judicial, reputation-destroying, and career-ending..... procedural integrity is everything. If the process is unconstitutional, the outcome should logically be unconstitutional too.

Awarding damages while preserving the impeachment raises difficult questions:

• Can constitutional violations be cured with compensation?
• Does “substantial compliance” apply to a process this grave?
• Are we prioritizing political stability over constitutional supremacy?

Courts are the guardians of the Constitution. When they acknowledge a violation but allow the result to stand, it risks diluting the normative force of due process.

The Constitution protects process — not just outcomes.

This ruling deserves serious reflection, not celebration or outrage. Because today it may be one political figure. Tomorrow, it could be the standard applied to any Kenyan.

Constitutional rights must mean what they say.

Kenyans need to start asking harder questions about this unexplained money economy.

Many of you have walked into certain hotels, clubs, restaurants, lounges and car yards and found almost no serious business going on. A hotel has empty rooms, an empty restaurant, bored waiters and barely any movement, but if you are told that same hotel deposits millions of shillings every day as sales, even you will be shocked.

That is how dirty money enters the financial system. The money cannot remain in suitcases forever. At some point it must be given a business story. It must be called hotel sales, club sales, restaurant sales, consultancy income, car sales or real estate payments.

In serious jurisdictions, investigators do not just admire cash in suitcases and issue statements. They follow the money into the businesses that are used to clean it. If a club has no customers but claims huge daily sales, if a hotel has no guests but deposits millions, if a restaurant sells one cup of tea in a day but takes Ksh5 million to the bank in the evening, that is where the real investigation begins.

Banks already know these things because banks ask questions when deposits do not match the business reality. The question is why Kenyan authorities are not cracking down harder when everyone can see that some people are not running businesses, they are washing money.

This is why the Ksh65 million allegedly recovered in the Patrick Analo matter should not end as a suitcase story. Authorities must ask where such money was going next, which businesses would have received it, which banks would have accepted it, which assets would have absorbed it and who else is helping this dirty money look clean.

Kenya is full of businesses with no customers but huge money. That is not entrepreneurship but laundering with a business permit.
