HOUSTON, TEXAS - Yesterday, a federal judge granted a temporary restraining order against the State of Texas for excluding Islamic schools from Texas' voucher program, finding that in doing so the State had caused immediate, irreparable harm to Texas' Muslim parents.

The judge noted he was "troubled" by the exclusion of all Islamic schools, specifically asking the State's attorneys: "how is it that these [Islamic] schools have found themselves the waiting room?" and noting that "the appearance of 0 for 30 [approvals] should give [the state] pause."

The judge ordered the statewide extension of the TEFA deadline for *all* parents from Mar. 17 to Mar. 31 (meaning parents of children pre-K to 12 still have time to apply, if they wish to!). The judge also ordered that application links to participate in the TEFA program be provided to our plaintiff schools.

Perhaps, most telling was how quickly the State's justifications for excluding Islamic schools from Texas' voucher program collapsed in court. The State initially alleged concerns with Islamic schools' accreditations and accrediting body Cognia. But in court the State conceded that other Cognia-accredited schools had been approved. The State further conceded there was no evidence of alleged terror links for our plaintiff schools.

We welcome this significant step forward for our clients but this is only the first step in ensuring a level playing field for ALL Texas parents.
