CEHURD has issued a public statement expressing profound concern over proposals by the Uganda Police Force to introduce compulsory HIV testing of suspects prior to detention.
Compulsory HIV testing violates informed consent, confidentiality, the right to privacy, and the presumption of innocence. It is inconsistent with Uganda’s Constitution, national HIV laws, and international human rights and public health standards, and offers no public health benefit that cannot be achieved through voluntary, rights-based approaches.
Public health objectives are best advanced not weakened when they are pursued in strict compliance with human rights, the rule of law, and respect for human dignity. Uganda’s progress toward ending AIDS has been built on trust, consent, confidentiality, and community engagement. These principles must be preserved in all settings, including detention.
