Judges should talk less in Court

While hearing a petition of a lawyer who wanted to be designated as a senior advocate, the Chief Justice of India Justice Surya Kant reportedly said that some unemployed youth were like cockroaches, and end up becoming media persons, social media users, and RTI activists, who start attacking anyone.
He also reportedly said '' There were already parasites in society who attack the system, and you want to join hands with them ? ''.

When a lot of criticism was made of these remarks, he issued a clarification stating that he had been misquoted, and he was referring to people entering professions with fake and bogus degrees.

The point, however, is that why should he have made such observations at all, which compelled him to issue a clarification ? The bench presided over by the CJI should have heard the petitioner and the respondent, and then passed whatever order they thought suitable. How do cockroaches and parasites come into the picture ?
There is an oft quoted statement of a former Lord Chancellor of England Sir Francis Bacon '' A much talking judge is like an ill tuned cymbal '', which means judges should talk less in court. Their job is to listen, not talk, in court. Talking is the lawyer's job. Of course if the judge needs some clarification, he can ask the lawyer for it. But otherwise he should remain silent, and after the hearing pass whatever order he thinks appropriate. The pen is ultimately in his hand.

When I was in London once I visited the British High Court during the hearing of a case. There was almost pin drop silence in the courtroom, the lawyer arguing in a very low voice, and the judge hearing silently. Occasionally, the judge would ask the lawyer for some clarification, but otherwise he was silent throughout the hearing. This is how courts should function.

Former CJI Gavai, on a plea in a petition before the Supreme Court by a Hindu to restore the beheaded idol of Lord Vishnu at Khajuraho reportedly said :

“Go and ask the deity itself to do something. You say you are a staunch devotee of Lord Vishnu. So go and pray to it ( to restore its own head ) “

Where was the need for such a remark ? Gavai could have dismissed the petition simply saying that there was no merit in it.

Former CJI DY Chandrachud would talk endlessly in Court.

All this lowers the dignity of a Court, and it also increases the chances of the judge being misconstrued.

As a former Judge of the Supreme Court and as an elder brother, I respectfully advise the CJI and his companion Judges of the Supreme Court to pay heed to the dictum of Sir Francis Bacon, and start talking less in Court

Very unfortunate & somewhat general remark made by the CJI against youngsters. I understand that the youngster before him may be irresponsible, but such general remarks reflect his antipathy towards activists, which also mirrors the view of the fascist ruling establishment. The Communist Party of India takes a very critical view of the recent Supreme Court judgment restricting the applicability of the SC/ST (Prevention of Atrocities) Act to instances where casteist abuse takes place “within public view”. Such an interpretation risks invisiblising the lived realities of caste oppression in India. Caste discrimination and violence do not occur only in public spaces. Verbal humiliation, social exclusion, untouchability practices and even physical violence often take place within homes, workplaces and other private spaces shaped by entrenched caste hierarchies. A crime does not cease to be a crime merely because it occurred away from public gaze.

The judgment appears to overlook the spirit of the Protection of Civil Rights Act, 1955, which criminalised untouchability and all forms of disabilities and discrimination arising out of casteist practices. The struggle against caste oppression requires recognition of how caste power operates in everyday life, including in private domains where victims are most vulnerable and isolated. At a time when atrocities against Dalits and tribals are increasing across the country, legal interpretations must strengthen constitutional protections and the fight for dignity, equality and social justice, not narrow them.

• Rigveda Purusha Sukta (10.90): Four varnas created from Purusha’s body (Brahmin from mouth, Shudra from feet) – seen as divine hierarchy by birth.

• Manusmriti I.91: “One occupation only the Lord prescribed to the Shudra, to serve meekly the other three castes.”

• Manusmriti VIII.272: Shudra teaching Brahmins? Pour molten lead into his mouth & ears.

• Bhagavata Purana 11.17.49: “Vaishyas follow Brahmins; Shudras accept a master from higher orders for livelihood.”

• Manusmriti IX (general): Women have “love of bed, seat, ornament, impure desires, wrath, dishonesty, malice & bad conduct.”

• Manusmriti 5.148: “Women should never be independent – protected by father (childhood), husband (youth), son (old age).”

• Rigveda 8.33.17: “The mind of woman cannot be disciplined; she has very little intelligence.”

• Valmiki Ramayana (Aranya Kanda 45.29-30): “Women by nature are crooked, fickle, devoid of religious knowledge.”

• Sati (widow immolation): Not in early Vedas but later law-books glorified it as dharma/loyalty (banned 1829).

• Child marriage & dowry: Influenced by Smriti customs & patriarchal controls (Manusmriti has mixed but reinforcing views).

The divisive elements codified in Sanatana texts have separated & oppressed people for centuries.

Udhaynidhi Stalin’s remark, that Sanatana Dharma must be eradicated, has already been adjudged by courts as “hate speech and a clear attack on Hinduism carrying implications akin to genocide”.

Today, inside the Tamil Nadu assembly, Stalin repeated the statement. No one objected.
