Court of Appeal Victory

We are pleased to share a significant victory for our clients in a complex medical negligence claim.

The Court of Appeal found this to be a fit and proper case for appellate intervention in favour of the Plaintiffs.

The Court also emphasised that the Government should be appropriately advised on the reasonableness and prospects of a case before an appeal is filed. This was indeed one such case.

A key issue concerned the strict proof required for special damages, particularly where the losses were suffered by individuals from a rural village community.The case highlights the challenges faced by rural families in proving losses and expenses arising directly from an event.

Following a 7 day trial involving 15 witnesses, the High Court found liability against the relevant Defendants. On appeal, we successfully secured RM200,000 in aggravated damages, interest not previously awarded,special damages arising directly from the consequences of the event.
