FIRST ON FOX: Former Biden special counsel Jack Smith could face potential criminal prosecution after Republicans accused him of misleading Congress about the scope of his investigation into President Donald Trump.

House Judiciary Chairman Jim Jordan argues newly released records contradict Smith's sworn testimony that neither he nor his team reviewed lawmakers' text messages, calling for the Justice Department to determine whether criminal charges are warranted.

The referral comes after documents released by Sen. Chuck Grassley showed Smith's team accessed text messages from dozens of members of Congress and Trump administration officials during its investigations.
