@polio_raul76780@Alexapr_97@laminarflown@marcus_herve Absolutely incorrect. The plain view doctrine applies to if the officer saw the gun, which he did not and he admitted he did not know it was a weapon until he felt the gun. I never mentioned any warrant in my analysis. Read Terry v Ohio.
@polio_raul76780@laminarflown@marcus_herve Nope, he needs to have seen the bulge himself. He says himself he didn’t know it was a gun until he felt his bag after the defendant stated he did not consent to search, the touching of his bag on his body is a search. The gun will get suppressed into evidence in hearings.
Man the Vladdy comments are horrible. But people also are only looking at the one soundbite. The very next thing he says is “i tell myself like man they paid you all this money and you’re playing this bad?” He said he was frustrated with himself and understands the fans.
@DavidPSamson Not a walk back. The next words during the interview yesterday he said were that he obviously is frustrated with himself and understands he’s played horrible and even said “man they paid you all this money and you can’t do anything” criticizing his season.
@freddy_silver2 Not about posing a risk to you, but a threat of imminent death or serious bodily harm is the language of most statutes. An argument that a guy is harassing you doesn’t reach the level of saying he posed a risk of death or serious bodily injury. Obviously very fact dependent.
@alfredcota99@cjgaming10@chefkumquat even though he did retreat, we have no idea what kind of force was presented to the shooter in this instance. The assumption that one may have a weapon is not enough. In most jurisdictions, there needs to be an imment threat. Someone with a camera harassing you isn’t enough
@alfredcota99@cjgaming10@chefkumquat It’s not about invading your space rather than pose a deadly threat or a threat of serious bodily harm. If he was never threatened with any weapon, and he pulled out the gun first, even if retreating away, there was no Imment threat of serious bodily harm or death to him.
@MattMarinelli11 @NFLChaos@AdamSchefter@RobDemovsky This is not the civil issue, but filing a motion to seal in the criminal prosecution matter. Prosecution can argue that it not be sealed as well
@XipleETH @ihyhaze More like a sign of self love. Being bald is a huge commitment to maintain because being bald requires maintance every 1-2 days. It shows significant confidence in yourself to rock a bald look.
@GTthatSOB@jnova_mp3 There is case law on what is called shopkeepers privilege. Where if they have reasonable belief to think you stealing they can detain you for a reasonable amount of time. That is a civil theory tho, meaning if you just run away, I highly doubt cvs will waste money suing you.
@chungymunky@SheedHappens_ You know ball. MFK amyris homme extrait is one of the most slept on fragrances ever. Insane price, but damn does it smell good.
